Use of the Site is also governed by our Privacy Policy, which explains what information we collect, how we use it, and the choices you have, including in relation to cookies, analytics, advertising, and visitor-identification technologies.
7. Disclaimer of Warranties

8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL ARCOLE, ITS AFFILIATES, OR ITS AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, PARTNERS, MEMBERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ARCOLE’S AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS (US$100).
Some jurisdictions do not allow certain limitations of liability; in those jurisdictions our liability is limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless Arcole and its affiliates and their respective officers, directors, employees, partners, members, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your access to or use of the Site, your violation of these Terms, or your violation of any rights of another party.
10. Governing Law; Venue
These Terms and any dispute arising out of or related to them or the Site are governed by the laws of the State of Georgia, without regard to its conflict-of-laws principles. Each party submits to the exclusive jurisdiction of the state and federal courts located in Fulton County, Georgia, for any action arising out of or related to these Terms or the Site, and waives any objection to venue or forum non conveniens.
11. Changes to the Site and These Terms
We may modify, suspend, or discontinue any part of the Site at any time without notice. We may also update these Terms from time to time; the “Last Updated” date reflects the most recent change. Your continued use of the Site after an update constitutes your acceptance of the revised Terms.
12. Miscellaneous
If any provision of these Terms is held to be unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms, together with the Privacy Policy, are the entire agreement between you and Arcole regarding the Site.
